Terms of sale

These terms govern your purchases from Märka's online store. They cover ordering, payment, delivery, the right of withdrawal, complaints, and dispute resolution. They also include our contact details and a reference to our privacy policy.

1. About us

Below, Flowbic AB is referred to as "Märka", "we" or "us". You as a shopper are referred to as "customer", "you" or "buyer".

2. General

These terms apply between you and Märka when you make a purchase via our online store markalappar.se. By placing an order, you confirm that you have read and accepted these terms.

To purchase from us, you must be at least 18 years old or have a guardian's consent.

We reserve the right to correct any printing errors, sold-out items and price changes without prior notice, as well as errors in images and product descriptions.

3. Orders and contract

A contract is formed when we have confirmed your order via an order confirmation sent to the email address you provided. Before you complete the order, you will receive a summary of the products you have selected and their personalisation, the total price including VAT, any shipping costs, delivery information, and a link to these terms and our privacy policy.

Because our products are made to order based on the choices you make in the configurator (text, font, colour, motif, size, etc.), you are responsible for ensuring that the information you provide is correct, including the spelling of names. We recommend that you carefully review the preview and your order confirmation before production begins.

We reserve the right to refuse orders for personalised content that we judge to be unlawful or to infringe third-party rights (e.g. trademarks, copyright), threatening, hateful, discriminatory or otherwise offensive, or misleading or fraudulent. If an order is refused, any payment will be refunded within a reasonable time.

4. Prices and payment

All prices are stated in Swedish kronor (SEK) and include Swedish VAT (currently 25%). Prices apply until otherwise stated on the website. Any shipping cost is shown before you complete your purchase and is included in the total in checkout.

Payment is processed through Shopify's checkout. We currently accept card payments, Google Pay, Klarna and Shop Pay. Available payment methods may change — the ones you can actually choose are always shown at checkout before you complete your purchase.

We do not store your full card or bank account number ourselves; payment details are handled by the payment provider according to their terms and security standards.

5. Delivery

Detailed delivery terms — delivery area, production and delivery times, shipping cost, and handling of delayed letters — are set out in our delivery policy, which forms an integral part of these terms.

Risk for the goods passes to you as the buyer when the goods have been handed over. For delivery by letter that does not require a signature, the goods are considered handed over when PostNord has placed the letter in your mailbox or apartment building mailbox.

6. Right of withdrawal

Under the Swedish Distance and Off-Premises Contracts Act (2005:59), as a rule you have the right to withdraw from your purchase within 14 days of the day you received the goods, without giving any reason. You notify us via email (see §1) or by using the Swedish Consumer Agency's standard withdrawal form.

When the right of withdrawal is exercised, we will refund what you have paid, including any standard delivery cost, within 14 days. You bear the cost of return shipping and the condition of the goods until we have received them.

Important: the right of withdrawal does not apply to our name labels or other personalised products. Under chapter 2, section 11, point 3 of the Distance and Off-Premises Contracts Act, the right of withdrawal does not cover goods that have been made according to the consumer's instructions or have been given a clear personal touch. Because our name labels are produced to order with your chosen text, design and configuration, they are excluded from the right of withdrawal.

By completing the purchase, you confirm that you have been informed of and accept this exception. This does not affect your rights in the event of a defect in the goods — see §7.

7. Complaints and defects

The Swedish Consumer Sales Act (2022:260) applies in full to your purchases from us, including personalised goods. If the goods are defective — for example a printing error caused by us, damage during delivery, or otherwise deviating from what was agreed — you have the right to file a complaint. The complaint must be made within a reasonable time after you discovered or should have discovered the defect, and no later than 3 years from the date you received the goods. For defects that appear within two years of delivery, the defect is presumed to have existed at the time of delivery unless proven otherwise.

Send your complaint to hello@markalappar.se with the order number, a description of the defect, and a photo or other documentation if possible. We normally respond within one week with information on how we will handle the case.

If a complaint is upheld, you are primarily entitled to repair or replacement at no cost. If that is not possible or does not take place within a reasonable time, you have the right to a price reduction or to rescind the purchase, as well as reimbursement for reasonable return shipping.

Right of withdrawal means that you can cancel the purchase without giving a reason (does not apply to personalised goods, see §6). A complaint means that you assert that the goods are defective — that right always applies, including for personalised goods.

8. Warranty

In addition to the rights you have under the Consumer Sales Act, we provide the following undertaking: our name labels are designed to withstand machine dishwashing and 60° machine washing under normal use, in accordance with our care instructions.

The warranty does not apply in the case of incorrect use or care beyond the care recommendations, normal wear and tear, or damage caused by external factors (e.g. mechanical impact, contact with strong cleaning agents beyond ordinary dishwashing). The warranty does not affect your statutory rights under the Consumer Sales Act.

9. Limitation of liability

We are not liable for indirect or consequential damages, such as lost profits or losses in commercial activity, to the extent such limitation of liability is permitted under mandatory law. Nothing in these terms shall be construed as a limitation of any rights you have under mandatory consumer protection legislation.

We are not liable for delays or non-delivery caused by circumstances outside our control, e.g. natural disasters, war, strikes, government action, communication network failures or failures of our suppliers (force majeure).

10. Personal data

We process your personal data in accordance with our privacy policy, which forms an integral part of these terms. By purchasing from us, you confirm that you have read the privacy policy.

11. Cookies

Märka uses cookies and similar technologies. Information on the cookies used can be found in our cookie information and in the privacy policy. You can adjust your cookie preferences at any time via the banner and the "Cookie settings" link on the website.

12. Dispute resolution

We always want to resolve disputes as smoothly as possible. Contact us first at hello@markalappar.se and we will respond as soon as we can.

If we are unable to reach an agreement, you as a consumer may turn to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN), Box 174, 101 23 Stockholm, www.arn.se. We follow ARN's recommendations.

Consumers within the EU may also use the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr

Swedish law applies to the agreement. Disputes are ultimately resolved by general court, with Stockholm District Court (Stockholms tingsrätt) as the first instance, unless mandatory consumer protection legislation prescribes another forum.

13. Intellectual property rights

All content on markalappar.se — including text, images, graphics, logos, the configurator design and underlying code — belongs to Flowbic AB or our licensors and is protected by copyright, trademark and other intellectual property legislation. You may not copy, distribute or use the material for commercial purposes without our written consent.

You retain all rights to text and content you submit (e.g. names on the labels), but you grant us a limited right to use the content to produce and deliver your order, and to fulfil our statutory obligations.

14. Changes to these terms

We reserve the right to change these terms. The latest version is always published on markalappar.se with the date of the most recent update. Orders that have already been placed are governed by the terms in effect at the time of the order.
